Please read these terms carefully before using Kartatek

1. Introduction & Acceptance
Welcome to Kartatek ("Platform", "Service", "we", "us", "our"), a digital business card platform operated by Kartatek Solutions Ltd, a company registered in the Republic of Cyprus (Registration Number: HE408385, VAT: 60021843M). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Kartatek Solutions Ltd governing your access to and use of the Platform at www.kartatek.com and the web application at my.kartatek.com, including any associated services.
By registering an account, accessing, or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease use of the Platform.
If you are using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case 'you' refers to that entity.
2. Definitions
"Kartatek" or "Platform" means the digital business card service available at www.kartatek.com and my.kartatek.com.
"Account" means a registered user account on the Platform.
"Digital Card" means a digital business card created by a User on the Platform.
"Content" means any information, data, text, images, or other material uploaded or submitted to the Platform.
"Free Plan" means the no-cost tier of Service with limited features.
"Paid Plan" means any subscription-based tier with enhanced features, subject to applicable fees.
"GDPR" means the General Data Protection Regulation (EU) 2016/679.
3. Eligibility
To use the Platform, you must:
Be at least 16 years of age (or the age of digital consent in your jurisdiction, whichever is higher);
Have the legal capacity to enter into binding agreements;
Not be prohibited from using the Service under applicable law;
Provide accurate, current, and complete registration information.
We reserve the right to refuse service to anyone at our discretion.
4. Account Registration & Security
4.1 Registration
You may register using your email address or via supported third-party authentication providers (Google, LinkedIn). By using a third-party login, you authorise us to access your basic profile information from that provider in accordance with our Privacy Policy.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials. You agree to:
Use a strong, unique password;
Notify us immediately at kartatek.sales@gmail.com of any unauthorised access;
Not share your account with others or allow third parties to access it;
Ensure all activity under your account complies with these Terms.
Kartatek is not liable for any loss arising from unauthorised use of your account where you have failed to take reasonable precautions.
5. Permitted Use & Restrictions
5.1 Permitted Use
You may use the Platform to create, manage, and share digital business cards for lawful personal or professional purposes.
5.2 Prohibited Conduct
You agree not to:
Upload, transmit, or display Content that is unlawful, defamatory, obscene, harassing, fraudulent, or infringes any third-party rights;
Impersonate any person or entity or misrepresent your affiliation;
Use the Platform for spam, unsolicited communications, or phishing;
Attempt to reverse-engineer, decompile, or extract source code from the Platform;
Introduce malicious code, viruses, or interfere with Platform security or integrity;
Scrape, crawl, or systematically extract data from the Platform without prior written consent;
Use the Platform in a way that violates applicable laws, including data protection legislation;
Resell or commercially exploit the Platform without our express written authorisation.
6. Digital Cards & Public Sharing
When you create a Digital Card and generate a public shareable link, you acknowledge that:
The card and its contents will be accessible to anyone with the link, without requiring a login;
You are solely responsible for the accuracy and appropriateness of information displayed on your card;
You may revoke the public link at any time through your account settings;
Third parties who view your card may save or copy its content — we cannot control what viewers do with publicly shared information.
We recommend reviewing your card content carefully before making it public.
7. Plans, Fees & Payments
7.1 Free Plan
We offer a Free Plan with limited features at no charge. We reserve the right to modify, restrict, or discontinue the Free Plan at any time with reasonable notice.
7.2 Paid Plans
Paid Plans are billed on a subscription basis (monthly or annual, as selected). Fees are quoted inclusive or exclusive of applicable VAT as displayed at checkout.
7.3 Payment Processing
Payments are processed by Stripe, Inc. By providing payment information, you authorise us to charge the applicable fees. We do not store your full card details — these are handled directly by Stripe under their PCI-DSS compliant infrastructure.
7.4 Renewals & Cancellation
Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time via your account settings. Upon cancellation, your Paid Plan access continues until the end of the current billing period — no pro-rata refunds are issued unless required by applicable law.
7.5 Price Changes
We may change subscription prices at any time. Price changes will be communicated with at least 30 days' notice and will take effect at your next renewal.
7.6 Refund Policy
Refunds are not provided for change of mind. If you believe you have been charged in error, contact us at kartatek.sales@gmail.com within 14 days of the charge.
8. Intellectual Property
8.1 Our IP
All software, design, trademarks, logos, and content produced by Kartatek are owned by or licensed to Kartatek Solutions Ltd and are protected by intellectual property law. Nothing in these Terms grants you any rights in our IP beyond the limited licence to use the Platform for its intended purpose.
8.2 Your Content
You retain ownership of all Content you upload to the Platform. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and process your Content solely to operate and improve the Platform. You represent that you have all necessary rights to grant this licence.
8.3 Feedback
Any feedback, suggestions, or ideas you provide about the Platform may be used by us freely without obligation or compensation to you.
9. Privacy & Data Protection
Our collection and processing of your personal data is governed by our Privacy Policy, which forms part of these Terms and is incorporated herein by reference. By using the Platform, you confirm you have read and understood our Privacy Policy.
We process personal data in accordance with the GDPR and applicable Cyprus data protection law. Our lawful bases for processing include performance of a contract, legitimate interests, legal compliance, and consent (where required).
10. Third-Party Services
The Platform integrates with third-party services including but not limited to:
Stripe (payment processing)
Google / LinkedIn (authentication)
Google Analytics, Meta Pixel, Brevo (analytics and marketing)
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the conduct or content of third-party services.
11. Disclaimers & Limitation of Liability
11.1 No Warranty
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, or uninterrupted availability.
11.2 Limitation of Liability
To the maximum extent permitted by applicable law, Kartatek Solutions Ltd's total aggregate liability to you for any claims arising from or related to these Terms or use of the Platform shall not exceed the greater of: (a) the fees paid by you in the 12 months preceding the claim, or (b) EUR 100.
We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
11.3 Consumer Rights
Nothing in these Terms limits any rights you may have under mandatory consumer protection legislation that cannot be excluded by contract.
12. Indemnification
You agree to indemnify, defend, and hold harmless Kartatek Solutions Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
13. Termination
13.1 By You
You may close your account at any time through your account settings or by contacting us. Termination does not entitle you to a refund of any prepaid fees.
13.2 By Us
We may suspend or terminate your account without notice if you breach these Terms, engage in conduct harmful to other users or the Platform, or as required by law. We may also terminate the Platform entirely with 30 days' prior notice.
13.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. We will delete or anonymise your personal data in accordance with our Privacy Policy. Content you have shared publicly via links may remain accessible until those links are explicitly revoked.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.
Before initiating legal proceedings, we encourage you to contact us to resolve any dispute amicably. EU residents may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and us.
15.2 Amendments
We may update these Terms at any time. Material changes will be communicated by email or prominent notice on the Platform at least 14 days in advance. Continued use after the effective date constitutes acceptance.
15.3 Severability
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in full force.
15.4 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
15.5 Assignment
You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely, including in connection with a merger or acquisition.
